1. Introduction

These Terms and Conditions ("Agreement") govern your use of the NexusFleet mobile application ("App") provided by NexusOps ("Company"). By downloading or using the App, you ("User") agree to these terms. If you do not agree, do not use the App.

2. Description of Services

The App is provided completely free of charge and does not include any paid services or in-app purchases. It is a complimentary tool intended for users with access to an existing NexusOps company account. It provides functionality specifically designed for field use, including:

• Access to your company's vehicle database hosted by NexusOps, containing references to your company’s vehicles.
• Reporting exterior vehicle damage directly through the App.
• Vehicle check-in and check-out functionality for rental or leasing purposes.

3. Eligibility and Account Usage

• Users must be at least 18 years old and authorized by their company to access NexusOps’ services.
• Users are responsible for providing accurate information and maintaining the confidentiality of their account credentials.

4. Acceptable Use

Users agree to utilize the App solely for its intended purpose and in compliance with applicable laws. Prohibited activities include:

• Unauthorized access to, copying, distributing, or otherwise misusing the data within the App.
• Attempting to disrupt, compromise, or harm the security or integrity of the App.

5. Intellectual Property

The App and its contents are the intellectual property of NexusOps. Users are granted a limited, non-transferable, non-exclusive license solely for authorized business purposes.

6. Liability

Depending on your location, you may have rights under applicable privacy laws, including:NexusOps is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or reliance upon its information.

7. Privacy and Data Protection

Use of the App is governed by the NexusOps Privacy Policy. By using the App, you consent to data handling practices described therein.

8. Modification of Terms

NexusOps may modify this Agreement from time to time. Continued use of the App constitutes acceptance of the revised terms.

9. Governing Law

This Agreement is governed by the laws of Luxembourg.
